Classified Cosmetics Files Motion for Preliminary Injunction Against Del Laboratories

July 4, 2004 -- (www.classifiedcosmetics.com/), which makes ERA® FACE, the world’s first spray on foundation and other beauty products, has filed a Motion for Preliminary Injunction against cosmetics and over- the-counter pharmaceuticals maker Del Laboratories, Inc. [AMEX: DLI to enjoin Del’s further manufacture and sale of the “Sally Hansen Fast and Flawless Airbrush Makeup” and “Airbrush Legs” products.

“Based on the favorable rulings of the Federal Court thus far and the clear cut facts, it’s time to get this case to judgment ,” said Gary Hecker, managing director of Los Angeles-based patent, trademark and copyright firm The Hecker Law Group (www.hh.com), attorneys for plaintiff Classified Cosmetics®.

Los Angeles-based Classified Cosmetics® contends that New York-based Del Laboratories clearly infringes its United States Patent No. 6,589,541 and that an injunction is, therefore, justified. The hearing is set for 10:00 a.m. P.S.T. on July 19, 2004 in the United States District Court of California, Central District, Western Division. The Honorable A. Howard Matz is scheduled to preside.

DLI Holding Corp., a venture between Kelso & Co. and Church & Dwight Co. [NYSE: CHD, just announced separately a definitive contract to acquire Del Laboratories Inc. for $385 million cash and the assumption of about $80 million of debt.
